Legal Malpractice

Budd Larner's Legal Malpractice Group represents lawyers and law firms in matters involving the defense of malpractice claims in a wide variety of underlying areas of the law, and professional ethics and disciplinary matters.

Defense of Legal Malpractice Claims

Our attorneys have extensive expertise defending against professional legal malpractice claims. We leverage our considerable litigation experience with a deep understanding of the legal principles applicable to legal malpractice claims. We also understand the role of the insurer in malpractice litigation. We have defended attorneys and law firms accused of legal malpractice in many areas of the law including:

  • Intellectual property: patents, copyrights and trademarks
  • Family law (i.e., divorce; equitable distribution)
  • Real estate
  • Personal injury
  • Corporate transactions
  • Commercial litigation
  • Insurance law
  • Environmental law

Counseling and Representation on Professional Responsibility and Disciplinary Matters

Ethics rules often present difficult questions for lawyers and other professionals during representations. We counsel on conflict of interest, confidentiality and privilege, and withdrawal questions that lawyers may encounter in client relationships. When ethics inquiries are made, the firm will handle attorney ethics grievances and matters before the Disciplinary Review Board. We understand how the attorney disciplinary system works, and we are experienced in representing clients in disciplinary proceedings. We also possess experienced appellate attorneys to handle a wide variety of appellate reviews and appeals in this area of the law.

Experts

We also serve as expert witnesses in malpractice and ethics proceedings. We are frequently called upon by our clients and other attorneys to provide expert witness statements and testimony in civil litigation and disciplinary matters.
