An Overview of Child Custody Law in New Jersey

Decisions surrounding the custody and care of children are, for many families, the most significant, and emotional, in a divorce. Added to this dynamic is the nature of the law in this area, which as opposed to being comprised of hard and fast “bright-line” rules, is made up of anomalous standards which call upon the court to fashion, from the point of view of the “stranger in a black robe”, a custody and parenting time schema best for all concerned, particularly the children. The following represents a summary of the various standards applied by courts in New Jersey, as dictated by statute and case law, to determinations of custody and parenting time.
